erliaanom 0 Report post Posted July 20, 2010 Hi, I just want to know about this condition : Main tenants (a couple) rent out other rooms in the unit to other sub-tenants. They said they already inform the owner that they want to sublet the other rooms, and the owner agree. The sub-tenants won't sign tenancy agreement with the owner but with the main tenants who act as the owner of the unit. They also said that they will register their sub-tenants particular to HDB and the 'real' owner. I keep wondering...isn't it illegal? because all i know is there is a rule mentioning that 'tenant cannot sublet the unit they rent to others'. thanks for the feedback. Sublet, sub-sublet, sub-sub-sublet is not an issue: Real issues are: 1. HDB has rule that certain types of unit can accommodate certain number of tenants, cannot exceed the allowable number. 2. It is owner's responsibility to make sure the valid indentity of all tenants and make known to HDB. 3. If you are one of the tenants, and see another tenant brings in some "subtenant" - report to owner immediate to fight for your privacy/use of resources within unit.....or, even report to hdb directly if found "fishy". For TS, You mention sub-tenants won't sign tenancy agreement with the owner but with the main tenants who act as the owner of the unit. Who holding your deposit? If 1 day , the main tenant MIA. How are you going to get back ur deposit? Since you are not signing TA with the owner, the TA that you had sign with the main tenant. Basically it is just a pcs of paper. I believe it is illegal...usually it is stated in the Tenancy Agreement that 'Subletting is not allowed' as it can be quite messy to manage... bepgof 20 Report post Posted July 21, 2010 (edited) Points to add: 1. Unless, at first, owner "partial sublet" to the coupler. Owner submits application form w/ biodata of coupler. 2. Coupler find "subtenants". Coupler has no authority to submit application, owner must submit "subtenants" biodata and be responsible of the true identity of subtenants. Who collect rental and amount is private settlement. 3. Maximum occupants allowed: 1-2rm = 4ppl, 3 rm=6ppl, 4-5rm=9ppl.
