  1. wow you had a lawyer, good for you! i wrote an article on this on my housing blog. if you dont have a lawyer, it will be tough handling the resale transaction yourself. the sellers of my home did the same thing to me, asking for one month extension and then after that delaying and saying they deserve 2 more wks because they allowed us to have the 2nd appt with HDB 2 wks earlier. They also had a very scheming and sneaky housing agent who tried to intimidate and threaten us with policies which we seemingly were ignorant about. There were works in our house that had to be rectified by the seller but they managed to push them to us instead. In this case we had no choice cos if we didn't agree, we will be delaying indefinitely the completion of the sale. AND HDB doesn't care for such petty quarrels, saying that the issue had to be solved by us two parties, and without involving the HDB. We eventually got our flat after much stress. I screamed, cried and prayed at the last week they were staying there. I cannot believe they could be so wicked and vicious to us. From a cordial relationship (i even tried to recommend the seller to my interior designer because he does fish ponds and gardens), we ended in animosity. A couple of months later, their eldest son died. He just slumped over his computer when no one was home. So scary, but maybe it's fate. or bao ying, so they say...
  2. what if the agreement is that the seller stay for a week or two AFTER the completion of the sale...which means a later 2nd appt date means a later date the seller will move out mah.... what to do?
  3. I would appreciate any advice anyone can give me here. My husband and I bought a resale flat, application was sent in June and after technical inspection, there were some unauthorised works which HDB Branch office asked the seller to rectify by the 20th of July 2007. Of course, their agent did not inform us about this and wrote an appeal letter to HDB Branch office asking them to consider asking the buyer to undertake. They only told us about this letter at the 1st appointment which is yesterday, 16 August. Also, the HDB Branch office says by right the 1st appt should not have been carried out because the house is not in proper condition to be sold. In any case, now the seller is pushing us into a corner, giving us no time to decide whether to undertake the rectification. If we do it, the resale application will not be delayed and we will get our flat in time. If the seller does it, they will probably take a long time as they have not found a replacement flat and are in no hurry to move. Also, HDB Branch office says that there is no deadline for the seller to rectify the unauthorised works. Basically, if they do not rectify it, they will hold back the resale application and this will drag forever. It seems the only way to get them to do it quickly is to take legal action, which also seems to have nothing to work on as there is no black and white stating the seller has to vacate by a certain time, as the resale application has not even gone through. We were wondering if we could negotiate with the seller to reimburse some costs for our undertaking. The following are the unauthorised items: 1) Demolish or apply for a permit for the construction of feature wall at bomb shelter 2) Demolish raised platform at master bedroom (too high, window dangerous) 3) Apply for test report by Power Supply (wall was hacked and concealed wiring moved to adjacent wall but no tests were done to see if its ok) 4) Reinstate the ventilation opening of bomb shelter. Number 4 is fairly easy to handle as the seller had only covered up the opening with plywood. I do not know much about no. 1 and 3 and would like to find out the costs for those. As for no.2, the seller will not hack away the platform but apply to do a window grille instead. From my understanding, the permit to do a window grille is more expensive. I greatly appreciate anyone's advice here, and asap as everyday i wait delays our moving into the flat! Thanks so very very very much!
