  1. I dread this day. I saw ur 1st appt is in Jan 2010. I m 3 days earlier than u. but so what? i got a lousy seller from the start. push for the longest delay of handover as possible.
  2. forget to add, when i OTP, i issued 1k chq and 4 days later, i was told it bounced because or irregularities in signature. so the next day when i exercise to option, i withdraw cash for the seller. as long the 14days is valid, there will be no cancellation of contract.
  3. @mahjong7777: I kena this kind of seller before, anyhow threaten to cancel deal. I got so fed up becuase alot of time wasted. i even consulted lawyers and wanted to press charges with the agents. however becuase of the lousy law, agents can get away scott-free and most of the laws protecting the sellers! as long from the date u OTP, u have a 2 wks time frame, as long u pay the max 5k within this period, the house is still yours. but i tell u, there will be many stupid things happening from now till 1st appt. .... if the seller want to get away, make sure u get back whatever u paid (1000+4000+180+80), even if u want to engage a lawyer, u have to bear with some of the legal fees (provided u win the case). if u lose, u pay all. pester ur agents to submit the exercise to option to hdb resalenet asap, if not take back your 80 and do it yourself and throw away your agent (provided u have not signed commission of sale)
  4. Of course. You can go to http://www.isis.gov.sg/ and click on individual search. Then you must have either one of the following. 1.NRIC 2.Bankruptcy No. 3.Exact name 4.Business name It will cost u $6. But if u go for 1st appt, HDB will know whether u r a bankrupt or u owe them debts (taxes and etc) Note: I remember 6 or 7 years ago, when i did a bankruptcy search, it was free. But $6 is ok la.
  5. hey i remember u. i came across ur designs on another blog and i admire ur works. i dont have any fanciful themes, just minimal stuffs for minimize cleaning and maximize space. i will take the bedroom 1 and jelly will take the mbr. i will also leave the bedroom 2 empty. the flooring is still good, broken marbles which was the IN thing in the 80s. I remembered seeing it in many of my relatives flats. i supposed the hacking will consists... 1) kitchen floor tiles 2) kitchen wall tiles 3) bathrooms floor tiles 4) bathrooms wall tiles I also have a high ceiling, at more than 3m. so my painting budget will go up. what do u think?
  6. Hi there Yes, this unit already comes with a recess area (5sqm). I did the sums and it will cost in the neighborhood of 4000. I was lucky that the common toilet can be linked to bedroom 1 and the storeroom had already been hacked. I'm not a big fan with WIW, I prefer everything to be covered. I already brought 1 contractor to see this flat (someone who is not featured here), he roughly quoted me 20-23k. Would u be interested to draw some designs for me (kitchen layout, room layout and any other layout). I have limited ideas so I really appreciate different styles and designs. Cheers.

  8. hey, i just installed crizto toilet bowl in my 2 toilets. this is a thailand brand but all toilet bowls parts r made in china. i bought it a a promo set (toilet bowl + basin), i think it was about $278), not so bad, nice design and the flush system also not bad. but i have heard frm a contractor that baron have higher power flush system.

Some days ago, I email Mr Tay Kim Poh, HDB CEO about my situation : sellers playing games with buyers my email was fwd and replied by Mr Fong Kin Wai (Head of Resale dept) . So this is what he wrote. -------------------------------------------------------------------------------- We refer to your email of 3 Nov 2009 to our CEO, regarding your purchase of the above flat. 2 We wish to clarify that the sale and purchase of HDB flat is based on an Option to Purchase (OTP), which is a private contract between the buyers and the sellers. Once the buyers have exercised the OTP, a binding contract is entered into between the two parties. In the event that one party does not wish to proceed with the sale, the aggrieved party is entitled to take legal action to enforce the terms of the OTP for specific performance or to claim damages. 3 You will have to seek your own private solicitor's advice regarding your rights and remedies should the sellers refuse to proceed with the transaction. 4 If you need any clarification, you may contact our officer, Ms Ng Bee Lin, at 64903642.   10. yes, i have. so far, i have not buy any bed frames/ mattress but i know they have very attractive prices if you dont mind their brands. when brands r concerned, it can be very subjective. It will be best that u go shopping around. so far, i only buy their shoe cabinets and it was great, price r affordable and COD. I even saw the same shoe cabinet at my neighbourhood furniture shop and the price is higher than beds.sg! and havent include delivery fee. so beds.sg still cheaper in this case. when i shift into my new place, i will consider beds.sg because it is affordable. So far, the shoe cabinets i bought..over 1 yr plus is still in good condition. In the end , i even buy another same cabinet. during my 2nd purchase, there was a $30 rebate if u write about them in your blog
  11. Hey I am slow in reading this post early. I am a victim and have re-read 100s times of the contract and spoke to lawyers. All i can say is, we, buyers, r F. I also spoke to CASE, smallclaims, IEA. who knows the 2 agents i m dealing with are not even registered. All I can do is write to their company and we all know is a one-way email/letters. why why why tell me why, we r paying hard-earned $ and we r so stupid enough to get cheated. i am a victim.
  12. Dear bepgof i feel so angry for u! After all the planning and applying to various agencies, now u face the penalty from your bank and where are u going to stay in future. in my midst of looking and buying resale, i came to realize that these sellers are treating it as a game, a game u play with your little friends and can suka suka back up w/o any consequences. This is because based on all the contract terms, buyers r always at losing end. I think u shld take the "out-of-goodwill" approach before u use any legal proceedings, afterall, engaging a lawyer is both time-consuming and hefty, besides at the end of the case, buyers wont get much compensation. U can take the hdb officer's suggestion and talk the old couple to find another flat, maybe can help them to look for a suitable flat. Else use legal means to force the old couple OTP to go thru. I do not think u can sue the divorcee parties in your case. If there are any agents involved, I have given up on them because they will not be around when troubles strike. Moreover, they only know how to seal the deal and take the money and run. at the meantime, pls check with your bank whether r they able to waive the penalty with your special situation. I hope for the best for u.

  14. @JustAsking: does TS=Topic Starter? my situation is a long story and i am really too exhausted to repeat it. in any case, i have talked to the authorities, re-read the contract several times, consulted a lawyer and even pray to God i dont even know why in the 1st place i want to deal with these issues, just becuase i want to buy a place of my own and i have to deal with crap.
  15. I just dont have the trust in these people anymore. i go to high court also wont get compensated for my loss. think i just i blame on my bad luck. or i hope for the best.
  16. i even thought of bypassing the small claims and straightaway go to the high court. But do i want to fork out the 7-8k of legal fees? even though i can claim back from the other party if I win the case, at most I can claim back is 4-5k. so in the end, i will be a loser. I lose $ in legal fees, time and I still have no compensation. there r simply no laws to protect buyers, IMHO.
  17. i dont get it, you can offer 20k as cov is very very good already. and if this agent playing games with u, there is really no point to continue to deal with him because u will know that in the future, there will be more problems. i also understd that u r facing another prblem in another thread, which is ur purchased flat is still on the market for sale. seriously, only when we can weed out all agents, then we can have a peace of mind. so what we pay good commission $, we get lousy standards n bad services.
  18. i like to bring to your attention on my current situation. I have spoke to the 3 main bodies personally. 1)HDB 2)CASE 3)IEA In the case of HDB, even though the OTP form is a legal contract issued by them. However, they will not be involved in any dispute. so in short, when u buy house, u pay HDB money. When there is a problem, HDB ask u to seek your own legal advices. In the case of CASE, I can only lodge a complaint only to the agent whom I will be paying commission. Not the other party's agent. In the case of IEA, it is not a requirement for all housing agents to be registered under IEA, therefore u cannot lodge any complaints to any agents as long as they are not registered with IEA. I also have asked about my option of seeking and making a police report. So I was told only if the case involve cheating of money then I am able to do so. If it involves ways of conducts and work ethnics, then too bad. so the only way for me is to flame these agents. But you and I know very well that flaming doesnt make them go out of business.

  20. situation is: Agent 1 say sth to Agent 2, and Agent 2 relate what Agent 1 said wrongly. sth like that. if not then my fault, i misunderstand what my agent said to me.
  21. aiyah now the air is cleared. i spoke to the seller's agent myself. I actually wanted to call the seller n talk. IMHO, w/o the agents or any 3rd parties, buying resale is so much easier. now i know i wont have to stay long in hotel 81...si bei lucky
  22. the 8 wks extension is requested by the seller after completion date. I agreed to their terms, initially they asked for 6 wks so I say make it 8 wks if there are any mishaps. I am being very nice. Now their agent is saying they need another 4 wks and they will not pay rental to us even if we asked for. where got free lunch? Perhaps they think i provide free lunches. Honestly, I have spoke to the seller during OTP and viewing and didn't thought she is so shrewd. I seriously think is her agent who is trying to play punk. Only if we can by pass these kind of agents or there is a law protecting the consumers, then all of us can be saved. after this hurdle, the renovation with ID/contractors will come in and will come with/without troubles again. In actual fact, even if u pay good $ to ID, these IDs will cheat u/carrot u/squeeze u like they own this industry.
  23. in a nutshell, the hdb inspector inspected the flat earlier because he was happened to be in the vicinity so he go inspects. Dont' ask me why is this allowed, i have no ideas too and i also want to know y. the seller and her agent really very comical. on OTP, her agent wrote 30 days for all involved parties to reconsidered their decisions before submission. 1) her agent actually wanted to backdated the OTP form to 14 days earlier so we option to purchase and exercise to option on same day. 2) her agent was the one who say she will submitted the forms to resale net after we all signed n paid 5k because she can have an earlier 1st appt date. now her agent used this 30days to argue that we didnt give them enough time to make up their mind. also, when the seller sign her name on our appeal letter for early execution for 1st appt, her agent explained to her before she signed. now they go against the agreement and i really dont even think i shld keep my words on giving them free stay for 8wks. Even though i also signed the extension agreement, they go back on their words for early execution, i also can go back on my words for allowing extension. If both appt goes through, i will see that they have rights to even stay another day in my flat. Even in black and white, these people also want to play punk and jeopardize their reputation. with all these happenings, my agent have changed. he actually dont listen to the seller's agent anymore! he have become more aggressive. i think he had enough crap from the seller's agent. which is good for me. seriously, if the worse really happened, hdb will not do anything for me. even though OTP is a legal contract by them, they will not be involved in anything. we will have to seek our own legal advices. may i ask, who am i paying the stamp fees and whatever fees to if the transaction go thru? hdb is alrdy a big bully and now these agents and these sellers also bullies wannabe. i paying cov to the seller, she go vacation 1 month in dec/jan and because of that i cannot go for the earliest 1 appt, n she also signed and agreed on early 1st appt if hdb allows. Now, so many excuses just because i want to charge her rent for asking another 4 wks extension. if i didn't give her 8wks extension in first place, of course i will consider whether to charge her rent or not. I alrdy have to wait 2 mths before i can go for my 1st appt and the whole procedure will take places over 2 mth and with her extension of 8 wks rent-free. Not as if she give me 50% discount in her COV. ppl buy house, i also buy house and i have to buy a house with so many difficulties. i cannot imagine the time n effort n money i have to fork out if i were to sue for compensation. n the seller is a winner because she still stay in her flat and i already end my current lease and slping in hotel 81.
  24. I couldn't believe it! read this: The seller and I agreed and signed an early execution letter of 1st appt to HDB. When the seller signed on my appeal letter, the seller told me that she will produce her air ticket information if needed, even before I asked. She is going away for more than 1 mth vacation. So I was hoping I can get an earlier date with HDB. Also, I agreed to let her stay for additional 8 wks (rent-free) after completion date, she come and asked me for additional 4 weeks, so total 12 weeks. Plus, she now give pattern and say she feel uncomfortable letting hdb know about her travel details. So we follow the original appt, for me, no problem loh since cannot be help. Then just today, her agent call to kpkb, say even if the seller have signed on the appeal letter, they will not go for the 1st appt. Plus, if i were to charge her for additional 4 wks rental, they will not pay. So say the seller back-out from the early execution of 1st appt, i can also back-out from the agreement to let her stay for 8wks rent-free. Correct or not? So I want to know...have anyone sue for compensation, use legal means to deal with people who breach contract.
  25. Dear nesh, I wish you all the best this time round and hope u get ur flat by this December! I am also seeing red when u relate your indian co-worker story. Who can we blame? It is going to be a never-ending story. IMHO, buying a resale is not that ideal afterall when u met with sellers who want to keep on extending after completion date. This is because, of out goodwill, we gave them 8 weeks extension instead of their initial 6 weeks. Now, they want another 4 weeks, a whopping 12 weeks...where got such things. I signed my life at HDB and u stay 12 weeks longer and collected my hard earned cash (COV) and cannot afford rental on your own? shame on them. got $ buy resale also must wait 6mths no $ buy BTO wait even longer.
